Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the Figo! application and website (the "Service") operated by Figo! ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you represent that you have your parent's or legal guardian's permission to use the Service. By using the Service, you represent and warrant that you meet these requirements.

2. Account and Identity

The Service uses a progressive identity model:

Named guest: You may use the Service by providing your name, stored in a browser cookie. No account registration is required for basic features such as creating plans and RSVPing.
Verified account: You may verify your phone number to access social features (following, inviting, messaging). Verification creates a persistent account.

You are responsible for maintaining the confidentiality of your session and for all activity that occurs under your identity. Named guest sessions are tied to browser cookies and may be lost if cookies are cleared.

3. SMS and Phone Verification

By providing your phone number and requesting verification, you expressly consent to receive a one-time SMS text message containing a verification code from Figo!. You understand and agree that:

SMS is used solely for one-time account verification. We do not send marketing or promotional messages.
Message frequency: One SMS per verification request.
Message and data rates may apply depending on your carrier and mobile plan.
You may opt out at any time by replying STOP to any SMS message from us. Reply HELP for assistance.
Opting out of SMS will prevent you from verifying your phone number but will not affect your ability to use the Service as a named guest.
SMS delivery is provided by Twilio. Supported carriers include but are not limited to AT&T, T-Mobile, Verizon, and other major US and Canadian carriers. Carriers are not liable for delayed or undelivered messages.
Your phone number will not be shared with third parties for marketing or promotional purposes.

4. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable laws.
Impersonate another person or provide false information.
Harass, threaten, or abuse other users.
Create plans with the intent to deceive, spam, or mislead others.
Attempt to gain unauthorized access to the Service, other accounts, or our systems.
Use automated scripts, bots, or scrapers to access or interact with the Service without our written permission.
Interfere with or disrupt the integrity or performance of the Service.

5. User Content

You retain ownership of content you create on the Service (plans, RSVPs, messages). By posting content, you grant us a non-exclusive, worldwide, royalty-free license to display, distribute, and store your content as necessary to operate the Service. You are solely responsible for the content you post and represent that it does not infringe on any third party's rights.

6. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

7. Plan Visibility and Privacy

Plans you create may be set as public or private. Public plans are visible to all users. Private plans are visible only to you, invited users, and your followers. You are responsible for choosing the appropriate visibility for your plans. We are not responsible for information you choose to make public.

8. Third-Party Services

The Service integrates with third-party services including Google Places (location data), Twilio (SMS delivery), and calendar applications (iCal feeds). Your use of these integrations is subject to the respective third party's terms of service and privacy policies. We are not responsible for the practices of third-party services.

9. Intellectual Property

The Service, including its design, logos, and original content, is owned by Figo! and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our prior written consent.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE ARE NOT RESPONSIBLE FOR THE CONDUCT OF ANY USER, WHETHER ONLINE OR OFFLINE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FIGO! SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR DAMAGES ARISING FROM PLANS OR MEETUPS ARRANGED THROUGH THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify and hold harmless Figo!, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) will survive.

14. Governing Law

These Terms are governed by the laws of the State of Missouri, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts located in St. Louis, Missouri.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
